Terms of use
A fair agreement for using the ecosystem.
These terms govern the Explore Timberon public sites, bookings, land information, guest services, and user accounts.
1. Parties and services
“We,” “us,” and “our” mean Wiklund Properties LLC for property, booking, land, guest, and customer services, together with Strange Integrated Engineering when it operates supporting technology as our service provider. “Explore Timberon” is the public-facing ecosystem. You must be legally able to enter this agreement; account holders must be at least 18 or the age of majority where they live.
2. Public information
Community, travel, weather, road, service, property, map, and availability information may change and may contain reasonable errors. Verify important conditions with the responsible agency or provider before travel or a transaction. Nothing on the sites is legal, tax, investment, engineering, surveying, or financial advice.
3. Bookings
Prices, taxes, fees, occupancy limits, deposits, cancellation terms, house rules, and property-specific conditions shown during booking or in the confirmed reservation become part of your agreement. A booking is not final until accepted and confirmed. You agree to provide accurate information, pay authorized charges, follow safety and house rules, and be responsible for your party as permitted by law. Material misrepresentation, unsafe conduct, prohibited activity, or nonpayment may result in cancellation or removal subject to applicable law and the reservation terms.
4. Land listings and inquiries
Listings and financing examples are invitations to inquire, not a binding offer, guarantee, appraisal, or promise of financing. Acreage, boundaries, access, utilities, zoning, buildability, title, taxes, environmental conditions, and images must be independently verified. Any sale, financing, or lease depends on definitive signed documents, eligibility, due diligence, and applicable disclosures.
5. Accounts
Keep credentials confidential, use accurate information, and notify us promptly of suspected unauthorized access. You are responsible for activity under your account to the extent permitted by law. Roles and permissions may limit what you can access or change. We may suspend access reasonably necessary to protect people, property, systems, or data, investigate misuse, comply with law, or administer ended relationships.
6. Acceptable use
Do not use a service to break the law; harm, threaten, harass, discriminate, defraud, or invade privacy; introduce malware; bypass security or access controls; interfere with networks; scrape at disruptive scale; impersonate others; or use information obtained here for spam or unauthorized surveillance. Guest Wi-Fi must be used lawfully and reasonably; bandwidth and devices may be managed for security and fair access.
7. Content and intellectual property
The sites, software, branding, layout, photographs, text, graphics, and compilations are owned by us or our licensors and protected by law. We give you a limited, revocable, nontransferable right to use the services for their intended personal or authorized business purpose. You retain ownership of content you submit and give us a limited license to host, process, reproduce, and communicate it as needed to provide, secure, and improve the requested service.
8. Third-party services
Maps, payment, identity, communication, and linked services may have their own terms and privacy practices. We are not responsible for unrelated third-party content or services, though this does not limit responsibility the law does not allow us to exclude.
9. Disclaimers
To the fullest extent permitted by law, services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not guarantee uninterrupted availability, error-free information, cell or internet service, road or weather conditions, or that every property will suit a particular use. These disclaimers do not waive non-waivable warranties or rights.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, data, use, or goodwill, arising from the services. Our aggregate liability for a claim will not exceed the greater of $100 or the amount you paid us for the service giving rise to the claim during the prior six months. This section does not apply where prohibited, or to liability that cannot lawfully be limited.
11. Indemnity
To the extent permitted by law, you will defend and indemnify us from third-party claims arising from your unlawful use, your submitted content, or your material violation of these Terms. This does not require indemnity for our own negligence or misconduct where prohibited.
12. Disputes and governing law
Please contact us first so we can try to resolve a concern informally. New Mexico law governs these Terms without regard to conflict-of-law rules. Courts with jurisdiction in Otero County, New Mexico, will be the venue, unless consumer law gives you a different right. Nothing here requires arbitration or waives a right to a jury or class proceeding.
13. Changes, termination, and general terms
We may change services and these Terms. Material changes apply prospectively after notice; renewed account acceptance will be requested when appropriate. If a provision is unenforceable, the rest remains effective. Failure to enforce is not a waiver. You may not assign account rights without consent; we may assign these Terms with a business transfer. Provisions intended by their nature to survive will survive termination.
